Adult daughter back to school; parents pay tuition; who claims 1098-T

I have an adult daughter (30-years old) who is now in nursing school. As her parent, I am paying tuition to the school directly so it is not considered a 'gift' and doesn't apply to the $15,000/year gifting limit each parent has. The school provides a 1098-T which provides the total tuition paid for the year. There are no scholarships and no loans involved.

 

Who's income tax does the 1098-T get filed with? My daughter's or our's? I'm thinking my daughter's, but I want to be sure.

    If you are Not claiming the student as a dependent on your tax return then you cannot claim any education expenses or credits on your tax return for the student, including the Form 1098-T.  She would enter the 1098-T on her return.
