can i still claim the AOTC on my taxes if i did not receive a 1098 t from my school and my employer paid for my full tuition  for school

Q. can i still claim the AOTC on my taxes if i did not receive a 1098 t from my school and my employer paid for my full tuition  for school?

A. No, because all you expenses were paid for with tax free benefits.  Claiming the AOTC would amount to double dipping. 

 

There may a situation where you can claim some AOTC. By law your employer can only give you $5250 maximum, tax free. 

 If you got more than $5250, the amount above $5250 is usually already included in box 1 of  your w-2. Since you have essentially paid tax on that part, it  is considered your after tax money and that amount can be used  to claim the tuition credit.
