Brokerage mistakenly withheld "non-resident alien" tax on sale of Education IRA. The beneficiary IS a U.S. citizen. Brokerage won't fix the error. How can I get a refund?

    You can get a refund of an excess tax by filing a return. You cannot get a separate refund just for the nonresident alien tax.

     

    When you file a return, all income is added together and a tax is computed after adjustments, deductions and credits.

     

    All your withholding is also lumped together and your tax liability is subtracted from that amount.

     

    Because you paid extra tax, your refund should be larger.
