Question

Can I claim the fees paid (read - tuition) to an internship provider as education expenses?

I am enrolled in an unpaid dietetic internship program. As an intern you pay the program a tuition of about $10,000. There is no payment issued to the student. Would I be able to consider the $10,000 tuition for the program education expenses?

Depends on whether you are taking courses from an eligible education institution in which case you can get Lifetime Learning Credit if otherwise qualified.

    From the IRS:

Eligible educational institution.  An eligible educational institution is any college, university, vocational school, or other postsecondary educational institution eligible to par- ticipate in a student aid program administered by the U.S. Department of Education. It includes virtually all accredi- ted public, nonprofit, and proprietary (privately owned profit-making) postsecondary institutions.
The educational institution should be able to tell you if it is an eligible educational institution.
