We paid for our daughter's 2019 out of state tuition/fees/books/dorm through money we saved in a 529 education account.  She paid for her food through a part time job.  After graduation, she decided to stay in the other state, and went full time at her job.  What would determine whether we can or should claim her as a dependent?  The time on her own in 2019 was about 6 1/2 months.

the critical question is whether you provided over 50% of her support for the year

 

Her income is not part of the test to determine whether she is a dependent.

To qualify as a dependent, you daughter should meet the 5 tests below:

  • Relationship: Must be your child, adopted child, foster child, brother or sister, or a descendant of one of these (grand or nephew).
  • Residence: Must have the same residence for more than half the year. Time spent while away for school is considered living at home.
  • Age: Must be under age 19 or under 24 and a full-time student for at least 5 months. They can be any age if they are totally and permanently disabled.
