Did not receive a 1098-T for 2020 but paid tuition in 2020

I have seen this question posed quite often but I would like to make sure the IRS guidelines haven't changed. My final semester was in 2020 but it was billed in November of 2019 and the cost of the semester was included on the 2019 1098-T and box 7 is checked but my payments for the last semester were posted in January of 2020 and are not reflected on my 2019 1098-T. I have proof of the billing occurring in 2020 and can show that the amount is not reflected on the 1098-T forms and was not claimed on a previous return. Am I still able to claim the AOC on my 2020 return since I did pay tuition in 2020 but did not receive a 2020 1098-T?

Yes, you can still claim the AOTC if you did not receive a Form 1098-T because the school is not required to provide you a Form 1098-T if:

  • The student and/or the person able to claim the student as a dependent meets all other eligibility requirements to claim the credit, 
  • The student can show he or she was enrolled at an eligible educational institution, and 
  • You can substantiate the payment of qualified tuition and related expenses.

Be sure to keep records that show the student was enrolled and the amount of paid qualified tuition and related expenses. You may need to send copies if the IRS contacts you regarding your claim of the credit.
