Filing State Taxes as a Student

I am a student from Ohio that was going to school in Maryland. Due to virtual learning this past year I spent equal amounts of time in Ohio and Maryland but I did have an internship that required me to be onsite in Maryland. I only had income from Maryland for the entire year. Do I file state taxes in both states and would I be considered a part-time resident or non-resident of Maryland?

    If you parents are claiming you as a dependent, you are considered to be based in their home and had a temporary absence to college. This would make you an Ohio resident. You would file a MD non-resident form and an OH resident form. If your parents are not claiming you, the fact that you returned to Ohio, makes me think that is your home base of operations, license, insurance, etc.

     

    Your resident state taxes all income but gives a credit for income taxed by another state.  Please carefully follow these directions.

    You will need to prepare the states in a special order. You may need to delete both states and begin again.

     

    1. First, prepare your non-resident MD return. This creates your tax liability for the non-resident state. How do I file a nonresident state return?
    2. THEN prepare your resident OH state return and it will generate a credit for your income already being taxed in the non-resident state.
    3. The credit will be the lower of the state tax liabilities on the same income. You may owe your resident state.

    It isn't possible for the program to create a credit before it knows the liability. Your returns may be wrong if you do not prepare the states in this order.
