Hi. If my son is having his College tuition fully paid by a Trust for him, are we able to deduct his expenses?

His trust is being administered by an Executor of the Trust who only writes the checks. The money was given to him for College and other uses once he graduates.

Yes. As long as he is your dependent, you may claim the tuition credit, even though you did not pay the tuition.  This is true if the tuition was paid by a trust, by the student himself, by student loans,  or by the grand parents (or any one else).

If the tuition is paid by scholarships, you can still claim the credit, but the student would have to declare some of the scholarship as taxable income.
