I am a student gone part time in which I paid for my tuition;  however, my mother claimed me on her taxes but did not take the higher education credit from my 1098-T.  Am I able to take this credit?

No, you aren't eligible to claim the American Opportunity Tax Credit if:

  • Your filing status is Married Filing Separately.
  • Taxpayer is listed as a dependent on another person’s return.
  • You and your spouse were non-resident aliens.
  • You have a felony drug conviction.
