I had a child who is not a dependent attend college. I have form 1098-T. I paid the tuition, but the student is not my dependent. Can I claim the tuition on my taxes?

If you don't claim the student as a dependent on your return, you cannot claim the educational credit on your taxes.

Only the person who claims the student as a dependent (or the student himself if he can't be claimed as a dependent) can claim the tuition credit.  But, that person can can't the tuition , you paid, in calculating the credit. 

 

Although the general rule, in taxes, is that you must be the one making the payment, to get the deduction, there is an exception for education.
