If I do not yet have a Bachelor's degree and been in college for less than 4 years but I have over 180 college credits, can I claim American Opportunity Tax Credit again?

I have claimed it for 3 years but I had over 180 credits by the end of 2019. I was also in college for less than 4 years before 2020.

Yes, based on the information you provided and you meet the requirements below you should be eligible for the AOC.

 

The American Opportunity Credit is available for the first four years of a student's post-secondary education—the years of education immediately after high school. Students who have already completed four years of college education, or those for whom you have already claimed the AOTC four times on previously filed tax returns, aren't eligible.

 

The student must not have completed the first four years of post-secondary education as of the beginning of the taxable year. This definition is also determined by the school. 

To be eligible for AOTC, the student must:

  • Be pursuing a degree or other recognized education credential
  • Be enrolled at least half time for at least one academic period* beginning in the tax year
  • Not have finished the first four years of higher education at the beginning of the tax year
  • Not have claimed the AOTC or the former Hope credit for more than four tax years
  • Not have a felony drug conviction at the end of the tax year
