Question

If my scholarship on my 1098 is considered taxable, but my mom still claims me as a dependent... do I file my 1098 in my taxes or does she file my 1098? (I also worked)

If your mom is claiming you as a dependent then she should claim any benefit from the 1098-T.

To your point though, if your scholarships equaled or exceeded the cost of your tuition, then there is no benefit to be had for your mom either. In that scenario, neither of you need to file the 1098-T.

if Box 5 exceeds Box 1, then the student reports that on their tax return as the net is taxable income to the student.  HOWEVER, in many cases the student may not have enough income to be required to file a tax return

the 1098-T gets reported on the parents return if a) Box 1 is greater than Box 5 AND b) the student is claimed as a dependent of the parent.  In all other cases, the form gets reported on the student's tax return.
