India-US Tax Treaty Eligibility

I’m an Indian PhD student on an F1 visa. I moved to the US in Sep 2021, and will be filing as a non resident alien.

Under the India-US tax treaty, Indian students can claim a standard deduction. However, I was working in Germany and paid taxes for 1 year immediately prior to moving to the US. For my Indian tax returns, I’m a non resident of India. 

 

Am I eligible to claim a standard deduction under the India-US tax treaty? Thank you.

    According to Article 21 of the US and India tax treaty agreement, you may claim the  standard deduction. Please read this link for more information.
