Question: Am I eligible to claim the life learning credit?

 

I am an international student holding F-1 visa, but regarded as a resident alien for tax purposes since I passed the substantial presence test (2019 is the 6th calendar year since I studied and lived in the U.S.).  As a research assistant (RA), I received tuition benefits from the university and only paid student fees by myself. My 1098T form indicates the amount in Box 1 (payments received for qualified tuition and related expenses) and also shows the amount in Box 5 (scholarships or grants) which is smaller than the amount in Box 1. It is because the RA assistantships does not cover the student fees and I paid by myself as I mentioned above. When I used a turbo, it shows that I can receive some amounts as federal credits (=life learning credits). Am I eligible to claim the life learning credit?

Yes, as a resident alien, you are eligible for education credits. And in your case, as you have out-of-pocket education expenses, you are eligible for the Lifetime learning credit.
