lifetime Learning Credit & the state of Ohio Board of Rehabilitation

Hi,

Can I use the lifetime Learning Credit if the state of Ohio Board of Rehabilitation pays for my Tuition and the state college issues me a 1098-T? I already have used the 4 years of  the AOC credit. I am using TurboTax Premier and It is allowing the tax credit for $2000,  and I have reviewed IRS publication 970. Would the Ohio Board of Rehabilitation be considered a "third Party"? I had only used $640 of my own out of pocket money for course specific expenses and the rest of it was paid by the Ohio Board of Rehabilitation.

    A.  No. You may not claim a tuition credit, if the expenses were paid by a scholarship or other tax free assistance.  

    Such assistance is frequently, but not always, reported in box 5 of the 1098-T.  If not, the TurboTax interview  will ask about other assistance. 

     

     

    You may count the  $640 out of pocket money only if paid to the school.  Books and supplies are not qualified expenses for the Lifetime Learning Credit.
