Question

Out of state internship with a separate job

Hello, my daughter lives in New York State and attended college in New York.  She had a, roughly, 4 month unpaid internship in South Carolina but worked a separate job while there.  I'm wondering how to enter a few things for Taxes and could use some help.

1. When asked how many months did my daughter live with me, do I claim the full 12 months as she was a college student that entire time or 8 months?

2. Because she earned income in South Carolina, does she need to file a State Return for South Carolina?

Any help is greatly appreciated.

Yes, you can claim that she lived with you all 12 months of the year.  Attending college is considered a temporary absence.

She does need to file a non-resident SC return since she received SC income from wages earned in SC.  There is not a minimum income requirement that must be met.

To learn more, take a look at the following SC FAQ under the Filing Requirement section:

She must include the SC income on her NY state return. NY will give her a credit for the tax paid to SC, if any.
