Question

Students are exempt from counting days for 5 years. I am on F/J student status for last 4 years

Following is the detail of my presence in the US:
Year – Days in US – Visa Type
2020 –      366        –      F
2019 –      324        –      J/F
2018 –      326        –      J
2017 –      138        –      J
2016 –        11        –      B1

Based on the information you provided, you are considered as a nonresident in the year of 2020.  

 

As a F- visa holder, you have total 5 years being exempt lifetime ( not counting years hence nonresident status) including both J and F visa.  Therefore, you would be counting your exempt years start from 2017 until 2021.  You will be considered as a nonresident from 2017 until 2020 or possible 2021.  ( J visa 2017-2018, F visa 2019-2021). 

 

As TurboTax does not support nonresident status, you are suggested to use Sprintax to complete your filing of Form 1040-NR.
