Tuition credit for student I do not claim on taxes

I pay 100% tuition for my daughter at college but her other parent claims her every year on her taxes. Can I claim the education expenses on my taxes? Turbo Tax has her information as a family member but does not bring her up as an option on the education expenses.

In order to take the tuition credit on your return, you must claim your daughter as a dependent.   Only the taxpayer claiming the dependent is eligible to claim the education credit.

Even though you paid the tuition, the mother can claim the money you paid, for the tuition credit, on her return, because the student is her dependent. 

 

Although the general rule, in taxes, is that you must be the one making the payment, to get the deduction, there is an exception for education.
