What state of residency do you use for a college student dependent that goes to school in another state

I claim my daughter as a dependent who goes to college in NY. This year she made enough to file state taxes for NY. Is her residency state GA?

Yes, she would still be considered a resident of Georgia, unless she has made some effort to make New York her permanent home. 

 

Examples of actions that are considered to be making an effort to establish residency include:

 

  • Getting a NY driver's license.
  • Registering to vote in NY. 
  • Buying a home in NY.
  • Applying for an occupational license in NY.

 

Assuming she isn't planning to make NY her permanent home, she would file a NY nonresident tax return and pay taxes on her earnings in NY.
