$1400 stimulus and the American Rescue Plan (ARP)

Hello experts!

 

My father-in-law passed on 1-22-2021.  He was low income and my question is will he be eligible for the ARP $1400 stimulus inspite of the fact that he passed away 1-22-2021?  He has not recieved the check in his bank account or has been mailed the stimulus.  My assumption is that if he is eligible, I can claim it with his final 2021 tax return.  Any help would be greatly appreciated.

Yes, you can claim the 3rd stimulus payment on your father-in-law's final return.   According to the IRS, a point to note is that you cannot claim the third stimulus check for a person who died before 2021.
