I am F-1 student. However I live here more than 5 years. So I file regular form 1040 resident alien. Can I apply refund for FICA tax?

    No, as a Resident Alien, you cannot file for nor receive a refund of FICA tax.   If you were an individual with F-1 or J-1 status and considered a nonresident aliens for federal tax purposes, then you are not subject to Social Security tax withholding on your wages and can apply for a refund, if:

    • you have on-campus employment, or
    • you are authorized for Curricular Practical Training (CPT) or Optional Practical Training (OPT), or
    • you are authorized for employment due to Economic Hardship
