Can I claim my brother for a dependent? He is a 52-year-old with special needs. He does receive SS and Medicaid.

To take him as a dependent his gross income must be less than $4,200. Gross income is all income that is not exempt from tax. If he has no other income than the SS, this should be fine.

 

You must also have provided over half of his support for the tax year. As he is your brother, he does not have to live with you.
