Can I claim my domestic partner that I supported last year financially who did not work due to a disability?

He began receiving SSDI in about November last year, but prior to that, I had been supporting us solely with my income.

In order to claim an unrelated person as a dependent, they must meet all of the requirements for the Other Dependent Credit as a "Qualifying Relative". The qualifying relative must either live in the taxpayer's household all year or be related to the taxpayer as a child, sibling, parent, grandparent, niece or nephew, aunt or uncle, certain in-law, or certain step-relative.

 

  • Do they live with you? They must live at your residence all year or be on the list of “relatives who do not live with you” in Publication 501. About 30 types of relatives are on this list.
  • Do they make less than $4,400 in 2022? Your relative can't have a gross income of more than $4,400 in 2022 and be claimed by you as a dependent.
  • Do you financially support them? You must provide more than half of your relative’s total support each year.
