Can I fight my sons tax return when I had all rights to claim him and my grandbaby?

You can file your return how you want. If the IRS gets two returns with the same ssn on it they will investigate and send you each letters to determine who is able to claim someone. It may take them a while to match them up. If your efile rejects because his return got accepted first you can mail yours in.
