Question

Can I file head of household? I'm divorced with 2 kids, 50/50 custody, I get to claim both kids this year. I'm living with parents and pay 50% of expenses.

You can claim head of household if all the following is true, which seems to be the case for you:

You are unmarried or considered unmarried on the last day of the year.  

You paid more than half the cost of keeping up a home for the year. 

A qualifying person lived with you in the home for more than half the year (except for temporary absences, such as school). However, if the qualifying person is your dependent parent, he or she doesn't have to live with you.

Would this still apply if my ex gets to claim one of our kids next year? I would assume so, but just want to be sure.
