Can I file married with my ex husband we've been divorced since 2017 we have children together

No, you cannot file Married Filing Joint with your Ex-Husband for 2017 or 2018 since your divorce was finalized in 2017.  

Because you were divorced by the last day of the year of 2017, you are considered Single for tax purposes for 2017 and 2018.

Your filing status options for 2017 and 2018 are:

  • Single  or
  • Head of Household (HOH): To use this status, you must have provided over half the cost to run your home for you and a Qualifying Child.  Please check out this TurboTax FAQ for a complete description of the requirements you must meet for the HOH filing status:  Do I Qualify for HOH?
