Question

Can I get my late file penalty forgiven?

I filed my 2021 taxes on tine but they were rejected because my 2020 agi did not match what the IRS had. IRS had changed my agi, I got the corrected AGiI, file taxes after the deadline and they were accepted. I now have a $219.30 penalty for late file. I was assured by the turbo tax folks that i would not get a  penalty.

You may qualify for first time penalty abatement.

This is available to taxpayers who receive penalties for failing to file a tax return, pay on time, and/or to deposit taxes when due if the following are true:

  • You didn’t previously have to file a return or you have no penalties for the three tax years prior to the tax year in which you received a penalty.
  • You filed all currently required returns or filed an extension of time to file.
  • You have paid, or arranged to pay, any tax due.

Call the toll-free number on your notice either to resolve the issue with your notice or to determine if you are eligible for First Time Penalty Abatement or other administrative waiver.

You had 5 days to refile the return after the filing  deadline either by efile or mail to be considered timely filed so although you can ask for a waiver of the penalty they are not required to grant you one and the interest is never forgiven.
