Noncustodial parents (the parent that doesn’t live with the kids) can claim their children as dependents if the following applies:

  • The custodial parent (the parent that lives with the children) signs Form 8332 (or a similar statement) that releases him to claim the children as dependents.

The noncustodial parent can claim the following that benefits:

  1. The dependent exemption

  2. The child tax credit

The custodial parent can claim:

  1. Head of household filing status

  2. The earned income credit

  3. The child and dependent care credit
