Can the state take my tax return for a debt she owes and owed prior to us getting married

It is possible.  On the federal side, Form 8379 lets you (the "injured spouse") get back your portion of a jointly-filed refund if it's seized or offset to pay your spouse's debt.  Not all states have their own injured spouse form and not all states recognize the injured spouse status.  To find the rules for your state select your state below.
