Do I have to pay the 40$ for my state to be filed? Can I do it for free on my own?

I have to select the deluxe for my tax situation which is 39$ but also it’s saying I have to pay an additional 39$ to file my state tax. Is there anyway to not?

You could try going to your state's tax web site to prepare a state return on your own.  You will need information from your federal return.

TurboTax Online does not charge an e-filing fee.  The TurboTax fee is for the preparation of your tax returns.  If your tax situation requires you to upgrade from the Free Edition, there is a charge for both federal and state preparation.  If you want to print or e-file, you will be prompted to pay the fees.

 

You have the option to file only your federal, and, as @xmasbaby0 stated above, you can prepare the state return on your own.  In addition, you can check your state's Department of Revenue website for other (sometimes free) options to prepare and e-file your state return.  Refer to the following Help Article for your state's website:  How do I contact my state Department of Revenue? - Intuit
