Question

Do I need a new W2 if I paid my employer back (in 2021) for vacation days used during FMLA (in 2020) upon resigning before my contract was up?

I am a contract, salaried employee. I took FMLA through my employer for maternity leave in 2020. I had to use vacation days in order to get paid. They paid me that money. When I returned to work in November of 2020, I decided to resign. This broke my contract so I owed them the money back they paid me for those vacation days used. They invoiced me in 2021 and I paid them back in 2021. They aren't giving me any information on whether or not I need a new form.

It sounds like this may affect your 2021 taxes, since you repaid the vacation pay back to your employer in 2021.

Your 2020 W-2 does report your wages paid in 2020 correctly.
