Do I need to file Form 8962?

Hello,

 

I am 75 yrs old immigrant from India, got greencard last year. However, we have not lived more than3 weeks in USA last year and didn't take any premium tax credit and no 1095a. However, this year, we got premium tax credit through marketplace. While filing tax returns for last year, do I need to file form 8962 or 1095a? If dont file these forms for last year, will my premium tax credit can be extended at the end of this year for the next year, since the system will check if I filed taxes or not?

    No.  If you did not get insurance through the marketplace last year, you would not need to include it on your return this year.

    When you file your return for next year, you will get a 1095-A that will include everything for this year on it.  You will then include that on your return.

     

    Each tax year is its own year.  So you would not include anything from 2024 on your 2025 return.

    Thank you, @Vanessa A and @xmasbaby0 for your quick responses.

    I read somewhere that during extension of premium tax credit in the marketplace, they automatically check if tax returns were filed for last year and only after passing validations, my credit would get extension to next year. In the marketplace, I also saw a note asking for my permission to check IRS and extend in Dec-2025.

    How does this check will pass if I dont submit form 8962, since I dont have 1095-A?

    Since you did not enroll in 2024, you cannot enter anything for 2024.

    The credit has nothing to do with your last years income is it strictly based on your income for the year you are enrolled. 

    I am not sure where you saw the note asking for permission to check IRS and extend in 2025?  On the marketplace site? If this is where you saw it, then all you need to do at the end of the year is to call them and redo your application.  It is better to update at the end of the year to be sure that you still qualify and also at the end of the year, you will have a better idea of what your income will be going in the 2026.

    You do not enter anything about a 1095A on a 2024 tax return if you did not have marketplace health insurance in 2024.   If you have marketplace health insurance for 2025, you will enter a 1095A on a 2025 tax return next year.
