Do i need to fill out a injured spouse form (8379) if we owe taxes?
The form is designed for me to get a refund if one is due but we are not due a refund we actually owe the IRS taxes.
No. Since you owe taxes, you should NOT file an injured spouse claim. One of the requirements for filing an injured spouse claim is that you have to be entitled to a refund.
