Do I need to open up estate account if I'm filing for my deceased father that doesn't have executor, appointed person etc. He had nothing when he died just me

Father didn't have anything no will put in place no nothing. I was his beneficiary. I'm getting to see if I have to file for probate or not.  Bottom line is after filling form 1310 is the refund issued in the deceased name. Or if I'm filing for him is it going to be in my name.

Not much point in probate if there is nothing in the estate.

 

The refund check should be made payable to you if you file Form 1310.
