Do you file the injured spouse form after or during filing taxes?

You can file Form 8379, Injured Spouse Allocation when you file your return or after you file!

If you haven't filed, please follow the steps below:

  • Log into your return and continue it.
  • Click on Federal in the left column
  • Click on Other Tax Situations
  • under Other Tax Forms, click on the button beside Miscellaneous Tax Forms. 
  • Click the button beside “Report an injured or innocent spouse claim”.

If you have filed, you will need to mail it to the IRS but you can still use TurboTax to prepare the form.  

To prepare Form 8379 without amending please follow the steps below.

  • If you are using Turbo Tax Online, sign back into Turbo Tax.  This will take you to the “Welcome Home” screen. 
  • On the Tax Home screen look under 2017 and click on Amend (change) return.  You are not actually going to amend your return.
  • Click on Federal in the left column
  • Click on Other Tax Situations
  • Under Other Tax Forms, click on the button beside Miscellaneous Tax Forms. 
  • Click the button beside “Report an injured or innocent spouse claim”. 

Work through the screens carefully.  You need to answer the injured spouse questions – not the innocent spouse questions.

When you have completed the form, you will need to print the form and mail it to the IRS.  Please go to click here and look at “Where to File”.  It would be a good idea to read the whole link as it has great information.
