F-1 to H1-B in a single tax year

Hello -

I am trying to submit my tax return for 2021.

I entered the US in August 2017 on F-1 and my visa status changed to H1-B on 10/1/2021. I looked up the 4011 IRS document and it looks like I qualify as a non-resident alien but I am unable to claim standard deduction on my tax return.

Sprintax is not allowing me to claim Standard Deduction but I have some colleagues that have been able to via Sprintax who have gone through the same process and situation.

I have reached out to the live agents and they have told me that I am ineligible for that but my resident country is India.

Is there someone that can help me with this issue?

According to the IRS only certain residents of India will qualify for the standard deduction if filing a 1040-NR.

Check here to see if you meet the qualifications.

If you do then you need to contact Sprintax again for live help.

I did look it up and I was on my student visa (F-1) for majority of the year and do not meet SPT since it does not have enough days until 12/31/21

Sprintax does not allow me to select/verify treaty info.
