First time filing under H1B - Questions on filing jointly (spouse/dependents)

Hi,

This is my first time applying for tax return under H1B. My spouse and dependents (under H4) does not have the ITINs.

I read that it is not possible to e-file jointly. In this case should I

select  - married filing separately: Get the tax return and file W-7 (ITIN) for my spouse and dependents - And amend the tax return (before April 18 - if I have them by then).

If I have the ITINs after April 18, is it possible to claim tax/child credits for the year 2021.

Excuse me for the naivety,  any suggestions/comments will be of great help.

Thanks

M

You can file the tax return along with the application for ITIN for your spouse and dependents.

They will first process the ITIN application, allot the ITINumber and then process your tax return.

There are three ways you can do the application for ITIN

I  Prepare your tax return and application forms for ITIN for your spouse and dependents

Get an appointment from the  IRS office near you

Take all the original documents(with copies) along with your spouse and dependents.

They will verify and give you back the original documents and process W7 and the tax return.

2 Search for Certified Acceptance Agent in the IRS website in your area and go to CAA who can verify and certify your documents in your W7 form and send it to IRS

at the following address(CAA may send it)

IRS ITIN Operations

PO Box 149342

Austin Tx 787149342.

3. You can directly send it by mail the tax return, W&7, and the original documents for IRS to verify and they will send back the documents to you.

This is the least preferred way.
