Question

Form 8917 has been discontinued since year 2017. Why is TurboTax including it in my tax return? I think it's a violation since the 2019 form 1040 and 2017 form differs greatly.

The December 2019 Congressional spending bill (PDF) introduced several retroactive tax extenders. The Tuition and Fees Deduction (on Form 8917) was one of those extenders.

Here is the text from page 695 of the bill:

SEC. 104. DEDUCTION OF QUALIFIED TUITION AND RELATED EXPENSES. (a) IN GENERAL.—Section 222(e) is amended by striking ‘‘December 31, 2017’’ and inserting ‘‘December 31, 2020’’. (b) EFFECTIVE DATE.—The amendment made by this section shall apply to taxable years beginning after December 31, 2017.
