GiG Worker w/ EIN + Solo 401k - One Company Did NOT Use My EIN I Provided Them

I deliver as a gig worker for 5 different companies including Uber, which did use my provided EIN I gave to them instead of my social security number. 

 

I use my EIN because my solo 401k at TD Ameritrade required it to set up the account.

 

One company completely disregarded my request to use my EIN instead of my social security number. They acknowledged  that they should have changed it when I requested it 2 months ago, but that now it is too late.

 

I think this is a problem because the income I earned will not show up as earned by my EIN and will not be eligible for me to contribute to my solo 401k with it.

 

If I can't contribute to my solo 401k with it on the employer side then I won't be able to deduct this amount from my earned income and that is a problem.

There should not be any problem as your SSN is linked to your EIN as a sole proprietor. 

 

You can include the income from the company which used your SSN on your Schedule C and your contribution to to your solo 401(k) will be based on your total net income.
