H1b visa holder can I use turbotax to e-file my tax return?

I am on H1B visa since 07/14/2016 and before that I had an OPT (F1). Can I use turbotax to e-file my tax return?

Absolutely ! You are considered as a resident for tax purposes if meet the Substantial Presence Test  after staying in US for five years.  In your situation, from 2008-2012, you are a nonresident not counting days while staying in US.  You will start counting your days from 1/1/2013.  During 2016,  if you met the SPT, you are a resident and required to file a Form 1040.  You can use TurboTax to complete your filing.

That depends.

 

If you meet the substantial presence test, you can file as a US Resident for tax purposes and use TurboTax, but if you don't have an ITIN (Individual Taxpayer Identification Number) you won't be able to E-file. Instead you will need to print and send the tax return with Form W-7.

If you don't meet the substantial presence test, you would need to file 1040NR, (Non-Resident Tax Return) which is NOT included in the TurboTax software. If that is the case, you CAN use SPRINTAX, which is an authorized partner of TurboTax.
