H4 Dependent Tax Filing

Hi,

My daughter is in H4 dependent Visa, studying in middle school. She stayed with me in UnitedStates for the entire year 2019. She don't have SSN, can I apply for ITIN during tax filing and claim her as my dependent in my tax filing?

Yes, there is a way to apply for an ITIN during tax filing. For details on how to do this, click these links for Form W-7 and Instructions for Form W-7 and look for the "When to Apply" section.  Note that you will need to print and mail this return with the application for the ITIN attached. 

 

According to IRS Publication 519, U.S. Tax Guide for Aliens at this link:

 

Resident aliens can claim their dependents in the same way as U.S. citizens. However, only nonresident aliens who are U.S. nationals, residents of Canada, Mexico, and South Korea; or residents of India who were students or business apprentices can have a qualifying dependent.
