Household Head status eligible if a couple lived separately less than 6 full months for the last 6 months of the year?

Hi,

My sister relocated to the west coast at the beginning of July 2019. My brother-in-law lived with my nephew on the east coast for the rest of 2019.  While they are still married, the husband has lived with wife for less than 6 full months during the last 6 months of 2019.  He meets all other requirements except the last 6 months criteria.  Can the husband still file as the household head?  Any thoughts?

Are they staying married?  If they are keeping the marriage together they should file a joint return even if they are living apart temporarily.

Thanks for your reply.

Yes, they are still married.  but for one of the five conditions -- considered unmarried

"Your spouse didn't live in your home after June (temporary absences due to illness, school, vacation, business, or military service don't count)"  

when the wife moved to the west coast at the beginning of July(7/7) permanently, could the husband still be considered meeting the 6 months condition?

if not living apart for the last 6 months of 2019 their only choice is joint or married filing separate (MFS).  with MFS many credits  and some deductions will not be allowed.
