You'll need to file a Form 8379 with your federal return to take advantage of the Injured Spouse procedure on that return. However, state procedures vary.

Not every state has provisions for an Injured Spouse procedure, and not all states have specific Injured Spouse forms.  To see the rules specific to your state, click on the relevant link in the article below.
