Question

How should we file taxes? I am currently arrears on child support. Taxes completely taken last year, should we file separate? Can't afford a tax offset with court.

file joint but include 8379.     you basically allocate income, deductions and tax payments between you.  your spouse gets the refund due her almost as if married fileing separate and yours is taken to cover the child support you owe.   marry filing separate can eliminate certain deductions and many tax credits.  however if you don't have any of theese married filing separate will produce the same result in the end.
