Question

How (status) should I file my taxes? My wife and I physically separated last year and started the paperwork but the separation was legal until 2022. How should we file?

We also sold a house that we lived in for a little over a year so we're hoping to get the profit excused as unforeseen circumstances.

If your divorce was not finalized on December 31,2021 you must file as Married- Joint or Separate (or Head of Household if you qualify).

 

You will be able to exclude partial gain on the sale of your home under the unforeseeable events.

You meet the standard requirements if during the time you owned and lived in the home you and your spouse became divorced or legally separated.
