I am self employed and filed deluxe last year. Does that still apply for me this year if I need to provide a part time employee a 1099? I

i am self employed and filed deluxe last year.  Does that still apply for me this year if I need to provide a part time employee a 1099?  I made 12,000 self employed in 2018 after expenses and paying my part time employee.  I am married filing jointly with 3 children.  My husband will have a W2 to file and money to report he made without a W2 or 1099.  Can I file deluxe and still provide a 1099 to my employee?  Or do I need to file self employed?  And can I file all our personal faxes on self employed?  My business is a licensed daycare (since I am a stay at home mom).  And I teach a preschool curriculum to other preschoolers for a few hours each morning.  (if that helps you) . Thank you!

Did you use the online Deluxe or the Desktop Deluxe program?  For Online you can only report self employment income in Deluxe.  If you had any expenses you had to upgrade to the Self Employed version.  Did you fill out schedule C for it last year?

Any way to issue a 1099Misc you need to use the Online Self Employed version or the Desktop Home & Business version to access QEF Quick Employer Forms.

Oh, you do not give employees a 1099Misc.  Employees get a W2 and you need to hold out FICA payroll taxes and be reporting quarterly payroll form 940.

You give a 1099Misc to independent contractors.  They are not employees.

And yes you file all your income and his W2 on the same tax return using the Self Employed version.

Last year I logged expenses and filled out a Schedule C on Deluxe.  Not sure if it was Desktop Deluxe or Deluxe.  We bought it at Costco and entered a code to use it since we did not have a drive. The other part time teacher knows she is a 1099/independent contractor.  So there is no way to do a 1099 on Deluxe?

Ok that was the Desktop program not the Online web Deluxe.  Sorry to fill out a 1099Misc you need either the Online Self Employed version or the Desktop Home & Business version.  You can fill out the 1099Misc and 1096 Transmittal forms some other way besides Turbo Tax and then still use Deluxe for your tax return and enter the total paid to Contract Labor on line 11.

That is not how it works.  In almost all cases, a 'helper' for your daycare business is an Employee, and you are required to do all of the payroll activities (quarterly employer forms, W-2/W-3, State Unemployment, Federal Unemployment, Worker's Compensation, etc.)

Yep. In most cases you can't just "choose" to make someone an independent contractor because it makes the paperwork easier for the business owner. If your "help" meets the requirements as clarified by the IRS and summarized in the link TGBill provided, they are a W-2 employee and you the employer have no choice or say in that matter.

No. Absolutely not. Employees, part time for full time get a W-2. You issue a 1099-MISC only to outside or third party contractors.
