Question

I am separated from my ex-wife. She has primary custody. I've paid over half of their expenses. Can I claim any of my children as dependents?

I live in Pennsylvania. I've paid over half of the household expenses for a home that I don't live in, including expenses for the children.  I also pay child support and spousal support.  Do I have a legal right to claim any of my children on my tax return?  Also, I am separated and living at my parents' house - which filing status should I choose, and can I file as head of household if I have dependants?

Only the custodial parent can claim the kids unless that parent gives permission to the other one via a signed form 8332.

If you are living with your parents you do not have a household since it is theirs so you can’t file as head of household. You would file as married separately.
