I had to pay the state money for overpayment but I did not receive a form. How do I submit this?

Please clarify.

  • What tax year did you receive the money from the Department of Labor and what tax form was it on, Form 1099-G?
  • What tax year did you repay the money from the Department of Labor?

Since you repaid in 2021 some of the unemployment income you received in 2020, there are a couple of ways you can get a tax break by reporting the repayment on your 2021 tax return.

  1. Take a simple deduction of the repaid income from your 2021 income (this is the easier option if you itemize your deductions).
  2. Use TurboTax CD/Download to calculate the amount of tax you overpaid and take a refundable credit. This is the more valuable option, but it takes more work to figure out the credit.

Here are the steps to take the simple deduction:

  1. Open or continue your return
  2. Select Federal >> Deductions & Credits
  3. Scroll down to Other Deductions and Credits (you may need to select See All Tax Breaks and/or Show More)
  4. Scroll down to Other Deductible Expenses and select Start (or Revisit)
  5. Answer the questions until you get to the Did you have any of these other expenses? screen.
  6. Select Yes
  7. On the Tell us about your other expenses screen, enter the amount of the repayment in the Claim of right repayment over $3,000 box and select Continue.

On your 2021 return when you enter your 1099-G for unemployment a question comes up and asks you repaid any unemployment.  Answer Yes.  Then your 1099-G will have a box to put in the amount that you repaid.
