I have a son but his dad (we are not married) is claiming him for. Do I still list that I have a dependent?

You can't get a dependent credit for your son if his father claims him for such. However, if your son lives with you for more than half the year, you may be able to file as head of household and use him to qualify for an earned income credit. So you do want to indicate in TurboTax that you have a son and answer the questions in the program about him.

Yes you still list him as a dependent, but not claiming him this year. You will have to fill out form 8332 release/revocation of release of claim to exemption for child by custodial parent.  If you have claimed him previous years on your returns but he wants to claim for this year.

In general you can not claim your child as a dependent if they do not live with you. As you go through the My Info section in TurboTax, we'll ask a series of questions to determine if somebody qualifies as your dependent.

 

Children who were under 19 at the end of 2022 (24 if they attended school full time for at least part of five calendar months of the year) must have lived with you for more than half of the year to be claimed. Some limited exceptions apply, such as children who are away from home because they’re sick, attending college, serving in the military, starting a business or taking a vacation.

 

For tax purposes, a dependent is someone “other than the taxpayer or spouse” who qualifies to be claimed by someone else on a tax return. More generally speaking, a dependent is someone who relies on another person for financial support, such as for housing, food, clothing, necessities, and more. Typically, this includes your children or other relatives, but it can also include people who aren’t directly related to you, such as a domestic partner.

Once you identify someone as a dependent on your tax return, you’re informing the IRS that you met the requirements to claim them as a dependent.

 

You can list him on your tax return as your son in case you qualify for other tax benefits regarding him.  Answers all follow-up questions and prompts in TurboTax.  And it will properly calculate any tax benefits if any apply.
