I have applied 2019 tax returns with spouse ITIN and i got return refund on Feb 2020.So can i update spouse ITIN to SSN now?what is the process can i get stimulus check?

H1B SSN + H4 ITIN + CHILD SSN is applicable for stimulus check payments ?

The IRS no longer will accept an amended return that is amended to change from an ITIN to a SSN.  The SSN must be on the originally filed return.  Only taxpayers will SSN will receive the stimulus payment (assuming they qualify).

mixed combination with SSN and ITIN are eligible for stimulus check payments?

Example H1B SSN + H4 ITIN + CHILD SSN is applicable for stimulus check payments?

Your spouse cannot get a stimulus check if she does not have a SSN.  You would received $1,200 + $500 for your child if your child qualifies and  he/she was listed on your tax return.

I’m upset over this dumb rule! My husband has an ITIN, I am a born and raised US citizen with 5children. We pay our taxes! We’re struggling during this pandemic and get ZERO help. I’m a nurse and working my butt off and TRUMP makes sure to stand tall about excluding the ENTIRE family. This is complete BS. But that’s ok, I’ll continue to work hard for my family and my patients!! #INTHISTOGETHER

I think stimulus check is part of 2020 tax credit. So I read some blogs saying that if your income reduces or have a new child in 2020, you will get the stimulus check  when you file tax returns in 2021 according to that. I think If you are able to get SSN for your wife now and you may get the tax credit or stimulus check when you apply 2020 tax returns in 2021. I am not 100% sure on this. But you can try. May be tax experts can shed some light on this.

Here is the text from IRS

A15. A valid SSN for a Payment is one that is valid for employment and is issued by the SSA before the due date of your 2019 tax return (including the filing deadline postponement to July 15 and an extension to October 15 if you request it) or your 2018 tax return (including extensions) if you haven’t filed your 2019 tax return.

 

Emphasize on the word “OR”

In 2018 I filed jointly with SSN + ITIN but both of us had an SSN during 2019. Somehow the SSN didn't get filed when I submitted our 2019 tax returns jointly. I even remember changing the SSN numbers, sadly.

 

Since the IRS local offices are closed for COVID-19, you can't convert the filed tax records in person. I just mailed off the paperwork to the IRS to switch the tax records. See "What do I do when I am assigned a social security number (SSN)?" at the link below:

Crossing my fingers we'll both get stimulus money since both of us get "Payment Status Not Available" when trying to use "Get My Payment" at the IRS now.

I am in the same situation, I am a born and raised US citizen and my husband and I file together he uses an ITIN and I use a SSN. I am a frontline worker , a respiratory therapist. Who goes into work every day during this pandemic, my husband is out of work. And we don’t get the stimulus, I am beyond upset at our government leaders and feel completely abandoned by our president.

Other Features of the 2020 Recovery Rebates  SSN Requirement: Taxpayers must provide a Social Security number (SSN) for themselves, their spouse (if married filing jointly), and any child for whom they claim the $500 child credit. Adoption taxpayer ID numbers (ATINs) are also acceptable for adopted children. Taxpayers who provide an individual taxpayer identification number (ITIN) are ineligible for the credit. Hence, married couples in which one spouse has an SSN and another has an ITIN are generally ineligible for the credit.  The law relaxes these ID requirements for married joint filers in which at least one spouse is a member of the Armed Forces. In those cases, only one spouse must provide an SSN.

 

 

This is the rule feature, there is a bug or Gap for those who filed 2019 with one SSN and one itin but received the SSN in 2020. No idea how IRS will handle this.

I m in the same situation. I used my wife’s ITIN instead of her SSN and now trying to change it. I will wait for IRS field offices to open

Same Boat, I got my spouse SSN on dec/jan, not sure how was missed while 2019 filing return, if I send now to IRS (after lock down end), will it be eligible to receive stimulus check?

If you see the Question #33 , this is what it says:

"If you are considered a U.S. resident alien for 2020 but not for 2019, you can claim the Payment when you file Form 1040 or Form 1040-SR with the IRS for tax year 2020."

Does this mean, if you get SSN in year 2020 will you become eligible stimulus payment when you file next year tax filing ?

I am on the same boat. I am H1 holder my wife has H4 as well ITIN number, my kid is US citizen. We jointly filed taxes every year for last 11 years but suddenly this clause gave us a shock. US government issued ITIN and H4 but now they are saying ITIN means unauthorized or illegal immigrants what an irony!!! How can a legal tax doc issued by government get accepted while filing Joint returns but gets ignored and labeled as illegal during pay back? This shows the blatant hypocrisy of this government. Now US citizens and SSN holders also not getting this payment because one of the family member, my spouse in this case doesn’t have SSN. This system is really broken and full of some racist and anti immigrant morons! It’s a disgrace that my kid being citizen with valid SSN is deprived due to 1 ITIN holder in the family while this useless government is issuing checks for international students. At least, citizens and SSN holders in a family should be eligible and not expected to be knocked off with mere excuse of ITIN existence. It’s a shame for this government to turn a blind on citizen’s rights!

Totally agree with you! In a way they are punishing US citizens for being married to immigrants or born to immigrant parents.
